Conditions governing access to and use of AscentVestor.

1. Scope
These Terms of Service (the “Terms”) govern access to and use of the AscentVestor platform, including the website at ascentvestor.com and the associated trading, backtesting, and portfolio-management applications (together, the “Platform”).
AscentVestor is operated by Dr. Andreas Unger, Gabelsbergerstr. 5, 85080 Gaimersheim, Germany (the “Operator”).
2. Private, invitation-only platform
AscentVestor is a private platform. Access is granted on an individual basis after direct contact with the Operator. There is no public sign-up, no application process, and no general right of admission. The Operator may decline or terminate access at its sole discretion.
3. No investment advice
The Platform provides software tools for automated trading and portfolio management. It does not constitute investment advice, financial planning, asset management, or any other regulated financial service. All trading decisions remain solely with the user.
Any backtest results, performance metrics, equity curves, Sharpe ratios, or similar figures displayed on the Platform or this website are historical or simulated and are not indicative of future performance. Live results may differ materially from backtests.
4. Trading risks
Trading securities, derivatives, and crypto-assets involves substantial risk, including the risk of total loss of capital. Leverage may amplify both gains and losses. The user is solely responsible for assessing the suitability of any strategy or instrument for their personal financial situation, risk tolerance, and regulatory environment.
The Platform routes orders to third-party brokers (Alpaca, Interactive Brokers, Bybit, and similar). The Operator is not a broker, custodian, or financial counterparty. All funds remain at the user’s broker at all times.
5. User obligations
- The user is responsible for the accuracy of credentials, broker configuration, and trading parameters supplied to the Platform.
- API keys are to be configured with trading rights only, without withdrawal permission, and bound to the platform server IP where supported by the broker.
- The user must comply with all applicable laws, including tax law and local trading regulations.
- Sharing of access credentials with third parties outside the permission framework of the Platform is not permitted.
6. Availability and changes
The Operator strives for high availability but does not guarantee uninterrupted access. Maintenance windows, third-party outages (brokers, hosting providers), and force-majeure events may temporarily affect the Platform.
Features, interfaces, supported brokers, and supported strategies may change over time. The Operator may discontinue individual features at reasonable notice.
7. Limitation of liability
To the extent permitted by law, the Operator is liable only for damages caused by intent or gross negligence. Liability for ordinary negligence is limited to damages typically foreseeable for this type of service and excludes lost profits and indirect damages, except where statutory provisions (in particular the German Product Liability Act, Produkthaftungsgesetz) require otherwise.
The Operator is not liable for trading losses, opportunity costs, or damages resulting from incorrect user configuration, third-party broker actions, market events, or regulatory changes.
8. Intellectual property
All software, code, content, design, and documentation provided through the Platform remain the exclusive property of the Operator or its licensors and are protected by copyright and other laws. Users receive a non-transferable, non-exclusive right of use limited to the agreed scope and duration of access.
9. Termination
Either party may terminate the use of the Platform at any time. Upon termination, the user’s access is revoked. The Operator may suspend or revoke access immediately for cause, including violations of these Terms or applicable law.
10. Governing law and jurisdiction
These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer-protection provisions of the user’s country of residence remain unaffected.
For users acting as merchants, legal entities under public law, or special funds under public law, the exclusive place of jurisdiction is the registered seat of the Operator.
11. Changes to these Terms
The Operator may amend these Terms at reasonable notice. Continued use of the Platform after notification of an amendment constitutes acceptance. If the user does not agree, the user may terminate access in accordance with section 9.
